Terms & Conditions

In these Terms and Conditions, the following words shall have the meanings set out below, unless the context requires otherwise:

By performing any one of the following actions, you are deemed to have read, understood, and fully agreed to these Terms and Conditions together with NobiPlay's Privacy Policy and Cookie Policy:

• Creating or registering a NobiPlay Account.
• Accessing or browsing content on the Platform, whether with or without an Account.
• Subscribing to or making payment for a premium plan.
• Downloading and installing the NobiPlay application on your device.
• Clicking the "Agree", "Sign Up", or a similar button on the Platform interface.

If you represent an organization or company, you represent that you have the authority to bind that organization to these Terms and Conditions.

3.1 Account Creation. To access certain features, you need to register an account by providing accurate, complete, and current information. You are fully responsible for the confidentiality of your password and for all activity that occurs through your account.

3.2 One Account per User. Each individual is only permitted to have one NobiPlay account. Creating multiple accounts to evade a ban, exploit promotions unfairly, or for any other purpose that violates these terms is prohibited.

3.3 Account Security. You must immediately notify us via our contact page or by emailing keamanan@nobiplay.id if you become aware of any unauthorized access to your account or a suspected security breach.

3.4 Identity Verification. NobiPlay reserves the right to request identity verification at any time for reasons of security, legal compliance, or fraud prevention. Failure to provide verification may result in restriction or suspension of the account.

4.1 Subscription Plans. NobiPlay offers several subscription tiers with different features. Prices and plan details may change from time to time with reasonable notice:

4.2 Billing Cycle. Billing occurs automatically at the start of each subscription period (monthly or annual) using your saved payment method. You are responsible for ensuring your payment method is valid and has a sufficient balance.

4.3 Cancellation. You may cancel your subscription at any time via the Profile → Manage Subscription → Cancel menu. Cancellation takes effect at the end of the current billing period. You may continue to enjoy premium features until the end of the period you have already paid for.

4.4 Refunds. NobiPlay provides a full refund guarantee within 48 hours of your first payment if you are not satisfied. After that period, a refund can only be processed in the following cases: (a) a billing error occurred on our part; (b) promised content is unavailable due to a disruption in our system; or (c) other cases as determined by our policy.

4.5 Price Changes. Any change to the subscription price will be notified at least 30 calendar days before it takes effect. You have the right to cancel your subscription before the price change takes effect without being charged any additional fee.

5.1 Grant of License. Subject to your compliance with these Terms and Conditions and payment of the applicable fees, NobiPlay grants you a limited, non-exclusive, non-transferable, and revocable license to access and watch the Content available through the Platform solely for personal, non-commercial use.

5.2 Scope of License. This license allows you to:

• Stream Content via supported Devices.
• Download Content for offline viewing (Premium and Family subscribers only, on authorized Devices, valid for 30 days or as limited by the content's license).
• Create and manage viewing profiles within the limits allowed by your plan.

5.3 License Restrictions. This license expressly does not permit you to:

• Copy, record, distribute, or download Content outside of the Platform's official features.
• Rent, sell, sublicense, or transfer your access to any other party.
• Use the Content for commercial purposes, including public broadcast or performance.
• Manipulate, alter, or create derivative works from the Content.

6.1 Platform Ownership. All elements of the NobiPlay Platform — including but not limited to interface design, logos, trademarks, software code, databases, and promotional materials — are the exclusive property of PT Indotech Digital Group or its licensors, and are protected by applicable Indonesian and international intellectual property law.

6.2 Third-Party Content. Most of the Content on the Platform is owned by film studios, production houses, and third-party licensors. NobiPlay distributes such Content under valid licensing agreements. Content availability may change from time to time in accordance with licensing terms.

6.3 User Content. If you submit reviews, comments, or other content to the Platform, you grant NobiPlay a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display that content within the Platform. You represent that you hold full rights to the content you submit.

6.4 Reporting Infringement. If you believe that content on the Platform infringes your intellectual property rights, please contact our legal team at haki@nobiplay.id, including relevant proof of ownership.

You are strictly prohibited from using NobiPlay for any purpose or in any manner that:

• Violates any law, rule, or regulation applicable in Indonesia or under international law.
• Attempts to gain unauthorized access to systems, networks, or other users' accounts.
• Uses bots, scrapers, crawlers, or other automated tools to collect data from the Platform.
• Manipulates, disrupts, or damages the integrity of the Platform's technical infrastructure.
• Distributes viruses, malware, spyware, or other malicious code.
• Places an unreasonable burden on the Platform's infrastructure (DDoS attacks, etc.).
• Falsifies identity or falsely claims an affiliation with NobiPlay.
• Disseminates content that is insulting, harassing, defamatory, or that incites hatred against individuals or groups.
• Uses the service for fraudulent activity, including money laundering, tax evasion, or illegal transactions.
• Attempts to reverse-engineer, disassemble, or extract the Platform's source code.

8.1 Privacy Commitment. NobiPlay is committed to protecting your privacy and personal data in accordance with the Personal Data Protection Law (UU PDP) No. 27 of 2022 and its implementing regulations.

8.2 Data We Collect. We collect data you provide directly (name, email, payment information), usage data (viewing history, preferences, interactions), and technical data (IP address, device type, activity logs).

8.3 Purpose of Data Use. Your data is used to: provide and improve the service; process payments; provide personalized content recommendations; send service communications and, with your consent, promotional communications; and comply with legal obligations.

8.4 Your Rights Over Your Data. You have the right to access, correct, delete, transfer, and restrict the processing of your personal data. To exercise these rights, contact privasi@nobiplay.id.

9.1 Termination by You. You may stop using the service at any time by cancelling your subscription and closing your account through the profile settings. Termination does not entitle you to a refund for any period already paid for, unless required by law.

9.2 Termination by NobiPlay. We reserve the right to suspend or terminate your account, with or without prior notice, if we have reasonable grounds to believe that you:

• Have violated any provision of this document.
• Are involved in fraudulent or harmful activity related to the Platform.
• Have failed to pay subscription fees that are due after the grace period.
• Have provided false or misleading information during registration or use of the service.

9.3 Effect of Termination. After account termination, you lose access to all Content, viewing history, offline downloads, and other related data. We may delete your data in accordance with the Privacy Policy and applicable legal obligations.

9.4 Termination of the Platform. NobiPlay reserves the right to discontinue all or part of the Platform's services with at least 90 days prior notice. In such a case, active subscriptions that have not yet expired will receive a pro-rated refund.

10.1 "As Is" Service. The NobiPlay Platform is provided on an "as is" and "as available" basis. NobiPlay makes no warranty of any kind, express or implied, regarding uninterrupted or error-free availability of the service, or fitness for a particular purpose.

10.2 Content Availability. We do not guarantee that any particular Content will remain permanently available. Content may be removed or have its access restricted at any time for reasons of licensing, copyright, or business policy.

10.3 Limitation of Damages. To the extent permitted by applicable law, NobiPlay's total liability to you for any claim arising from your use of the service shall not exceed the amount you paid us in the 12 months immediately preceding the claim.

10.4 Excluded Losses. NobiPlay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, data, or goodwill, arising from the use of, or inability to use, the Platform.

11.1 Governing Law. These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to any choice-of-law or conflict-of-law provisions.

11.2 Dispute Resolution. Any dispute arising out of or in connection with these Terms and Conditions shall be resolved through the following stages:

• Negotiation: The parties shall endeavor to resolve the dispute through good-faith negotiation within 30 days of notice of the dispute.
• Mediation: If negotiation fails, the dispute shall be referred to mediation through the relevant Consumer Dispute Resolution Agency (BPSK).
• Arbitration / Court: Disputes not resolved through mediation shall be brought before the South Jakarta District Court, or through arbitration at BANI (the Indonesian National Arbitration Board) by mutual agreement.

11.3 Language. This document is drawn up in Indonesian as the authentic language. Translations into other languages are provided solely for reference. In the event of any inconsistency, the Indonesian language version shall prevail.

12.1 Right to Change. NobiPlay reserves the right to change, add to, or remove any part of these Terms and Conditions at any time. Material changes will be notified to you through:

• An in-app or website notification at least 14 days before it takes effect.
• An email sent to the address registered on your account.
• A notification banner visible on the Platform's main page.

12.2 Consent to Changes. Continued use of the service after the effective date of a change constitutes your consent to the updated terms. If you do not agree to such changes, you may stop using the service and cancel your subscription before the change takes effect.

12.3 Version History. All previous versions of these Terms and Conditions are kept in our archives and may be requested via legal@nobiplay.id.
